Expungement of a criminal record is a process by which a criminal record of a convicted offender is expunged from the criminal record database of the Criminal Record Centre (CRC) of the South African Police Service (SAPS). In simpler terms, you won't have to worry about hearing of it on records again.
Your criminal record sits on the South African Police Service's records permanently, unless there is a change of ruling or expungement.
Having a record on your name can sometimes infringe your job oppurtunities and further create an obstruction to your day to day life. Hence, if you qualify, it's in your best interest to go through the process of having it taken off their system to remove that obstruction in your life and employment oppurtunities.
To have your criminal record expunged, there is a criteria you have to meet before applying. The requirements are as follows:
. A period of 10 years must have passed from the date of conviction for that offense.
. The sentence was persponed or the perso was cautioned and discharged
. Imprisonment with the option to pay a fine instead of serving the period of imprisonment.
. The fine did not exceed R20,000
. Imprisonment was suspended wholly.
. Correctional supervision in terms of section 276(1)(h) of the Act.
. Imprisonment in terms of section 276(1)(i) of the Act.
. Periodical imprisonment in term of section 276(1)(c) of the Act
